Copyright Questions Around AI Images

A practical risk-aware approach for creators and businesses using generated visuals.

Rules depend on place and use

Copyright treatment of generated work continues to develop and varies by jurisdiction. Human creative contribution, the model’s terms and the material used in the final composition can all matter. A generated file is not automatically safe for every commercial use.

Review the provider’s current license and keep records of the generation and edits. High-stakes campaigns should receive qualified legal review.

Avoid confusing similarity

Do not request a living artist’s exact style or reproduce recognizable characters, logos or product designs without permission. Similarity can create trademark, publicity and unfair competition issues even when copyright ownership is uncertain.

Use original art direction and licensed reference assets. Search important final images for unexpected resemblance before publication.

Build a clean workflow

Define approved tools, prohibited content and review thresholds. Retain prompts, source references and final edits. Clear internal rules are more reliable than deciding rights questions after a campaign has already launched.
